Terms of Service

AKC Universe is an entertainment and exploration platform built by and for the Absolute Kongs Club community. It allows users to migrate compatible NFTs between Ethereum and Base, explore a procedurally generated universe, complete missions, and engage in optional on-chain interactions.

The Service is provided for fun and community participation. It is not a financial product, investment vehicle, broker, exchange, custodian, or money transmitter. Nothing on the Service constitutes financial, legal, tax, or investment advice.

To use the Service you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater).
• Not be located in, or a resident or citizen of, any country or region subject to comprehensive sanctions (including, without limitation, those designated by OFAC).
• Not be listed on any sanctions, denied-persons, or terrorist watch list maintained by a governmental authority.
• Have the legal capacity to enter into and be bound by these Terms.

By using the Service you represent and warrant that you meet all of the above.

The Service authenticates users via cryptographic wallet signatures. You are solely responsible for the security of your wallet, private keys, seed phrases, and any device used to access them. We never have access to your private keys and cannot recover lost wallets, reverse signed transactions, or restore lost assets.

You expressly acknowledge and assume the following risks:

• Volatility: the value of cryptocurrencies and NFTs can fluctuate dramatically.
• Irreversibility: blockchain transactions are final and cannot be reversed, refunded, or cancelled once confirmed.
• Gas and network fees: network fees are paid to the underlying blockchain, are non-refundable, and are outside our control.
• Smart contract risk: the smart contracts powering the Service have been reviewed and audited prior to deployment, but no audit, review, or testing process can guarantee that a smart contract is bug-free, secure, or free from undiscovered vulnerabilities. All smart contracts may behave unexpectedly, fail under adversarial conditions, or interact in unforeseen ways with other contracts and protocols. Nothing on a public blockchain is ever 100% safe. You interact with all on-chain contracts at your own risk.
• Network outages: the Ethereum or Base networks, RPC providers, indexers, or third-party infrastructure may experience downtime, congestion, or reorganizations that affect the Service.
• Regulatory uncertainty: laws and regulations around digital assets are evolving and may change.

You agree that you alone are responsible for evaluating these risks before taking any action on the Service.

Ownership of an AKC NFT in your wallet grants you a worldwide, non-exclusive license to use, display, and reproduce the artwork of that specific NFT for personal and commercial purposes, for as long as you own it. Upon transfer of the NFT, this license transfers with the NFT to the new owner.

All other intellectual property in the Service - including but not limited to the AKC and AKC Universe brand names, logos, source code, game mechanics, written content, music, sound effects, generated maps, and concept artwork that is not part of an individual NFT - remains owned by AKC and its contributors. You may not copy, modify, distribute, or create derivative works of that material without prior written permission.

You agree not to:

• Use bots, scripts, scraping tools, or any automation to interact with the Service except where we explicitly support it.
• Exploit bugs, glitches, or unintended interactions in smart contracts or game logic for personal gain.
• Create or operate multiple accounts to circumvent limits, whitelists, or anti-Sybil measures.
• Engage in market manipulation, wash trading, or any activity intended to mislead other users.
• Use the Service to launder funds, evade sanctions, or finance illegal activity.
• Harass, threaten, dox, or impersonate other users or the AKC team.
• Attempt to compromise, reverse engineer, or interfere with the Service or its infrastructure.

We reserve the right to revoke whitelist access, ban wallets, void rewards, and take any other action we deem appropriate in response to violations.

The Service is an interface to public, permissionless blockchain networks. Every on-chain transaction is initiated, signed, and broadcast by you from your wallet. AKC does not custody your assets, does not control the underlying blockchains, and cannot reverse, refund, or recover any transaction, NFT, or token once it has been signed by you.

To the fullest extent permitted by applicable law, AKC, its contributors, and affiliates shall have no liability whatsoever for any loss, damage, or harm - whether direct, indirect, incidental, special, consequential, exemplary, or punitive - arising out of or related to: your use of or inability to use the Service; the volatility, loss, theft, or destruction of any cryptocurrency, NFT, or other digital asset; smart contract bugs, exploits, or unintended behavior; blockchain network outages, congestion, reorganizations, or forks; lost or compromised private keys, seed phrases, or wallets; phishing, scams, or actions of third parties; or any other cause connected to your participation in a public blockchain. This is true even if we have been advised of the possibility of such loss.

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where applicable law does not permit a full exclusion of liability, our aggregate liability to you for all claims, in the aggregate, is limited to the minimum amount required by that law, and to no greater amount.

You acknowledge that you are participating in experimental blockchain technology of your own free will, at your own discretion, and at your own risk.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms from time to time; the "Last updated" date above will reflect the most recent revision. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by general principles of contract law. Any dispute arising out of or relating to these Terms or the Service shall be resolved through good-faith discussion first, and, if unresolved, through binding arbitration on an individual (non-class) basis, to the extent permitted by your jurisdiction.
